  • Can sponsor eligible family member or relative under limited circumstances

Individual can be eligible for Protection Visa (subclass 866) if any of his/her family member is found to be engaged in Australia’s complementary protection obligations. Also meets with under stated criteria;

  • Arrived in Australia legally
  • Is a refugee as defined by the Migration Act 1958 or meet with Complementary Protection criteria in Australia
  • Application should be in the interest of Australia

Who are considered as refugees in Australia?

Under Australian law, refugees are people who have been forced to leave their origin country because of fear either due to;

  • race
  • religion
  • nationality
  • political opinion
  • membership of a particular social group.

According to Migration Act 1958, Australia is obliged to provide protection under Refugees Convention to such refugees and help them not to be returned to their origin country due to any the above five factors.

Note: Individual is not considered as refugee if they leave their home country for reasons of war, famine or because they are seeking better economic opportunities.

What is meant by Australia’s complementary protection obligations?

People who are not refugees but seek for protection for significant harm if they return to their origin country, are considered to be eligible under act of Complementary Protection in Australia.

The significant harm can be of;

  • arbitrary deprivation of life
  • the death penalty
  • torture
  • cruel or inhuman treatment or punishment, or
  • degrading treatment or punishment.
