Latest Updates for Partner Visa Holders (Subclass 309 & 820)

The Department of Home Affairs made an important announcement applicable to people with a provisional Partner visa (subclass 309) or with a temporary Partner visa (subclass 820). The announcement stated that the visa holders can now provide the details for the permanent visa after two years because their application was previously processed.

This is a positive development for those who must apply for a permanent visa under subclass 801 or subclass 100. Since two years have passed since the filing of the application, the Department will accept the required documentation in order to consider the petitioner for permanent residence.

The modification is in line with Australia’s partner visa regulations, which require applicants to apply for permanent residency (subclass 100 or 801) after first obtaining a temporary visa (subclass 309 or 820).  In regard to this, the new guidance is a source of confidence to applicants, as it states a stipulated period in which permanent visa progression will be acceptable.
